CDA Gaming Wins Temporary Licence Restoration in Brazil

A Brazilian appeals court has temporarily restored CDA Gaming’s authorisation, questioning the abrupt cancellation of a paid licence without reimbursement or compensation.

Brazil’s Federal Regional Court of the Third Region, TRF-3, has temporarily restored CDA Gaming’s betting authorisation following an appeal against the nationwide ban.

The November 3 decision by Judge Adriana Pileggi benefits Casa de Apostas, Betsul and Jogo Online. It also orders the restoration of domains and the operational, financial and payment services needed for the company’s activities. The relief applies exclusively to CDA Gaming and remains subject to further judicial review.

Appeal Overturns Initial Refusal

CDA Gaming initially sought protection from São Paulo’s 26th Federal Civil Court. That request was rejected on the grounds that the public interest in protecting people from gambling-related harm outweighed the company’s legal-certainty arguments.

On appeal, Pileggi questioned the abrupt termination of an authorisation for which CDA Gaming had paid R$30 million. The licence was originally valid until December 31, 2029.

The judge considered that ending the authorisation without refunding the fee or providing compensation could amount to confiscation. She also raised concerns about legal certainty, reasonableness and proportionality.

Court Questions Government’s Justification

According to reporting on the ruling, Pileggi argued that invoking public interest did not give the government unrestricted power to change an established legal arrangement unexpectedly.

The decision also questioned the provisional measure’s R$200,000 daily penalty for non-compliance. These findings form part of an interim ruling rather than a final determination of the ban’s constitutionality.

Earlier Stake Relief Was Suspended

CDA Gaming’s case follows an earlier challenge by Stake Brasil. Stake obtained partial interim protection in October, but the TRF-3 president suspended that decision at the federal government’s request.

The CDA ruling therefore provides company-specific relief rather than a general reopening of Brazil’s betting market. Other operators do not automatically regain their authorisations, while CDA Gaming remains subject to regulatory requirements and state supervision.
